Terms & Conditions
These Terms & Conditions govern your use of Dolooma Academy and the related Dolooma platform and services (the “Service”), operated by Dolooma Inc. (“Dolooma”, “we”, “us”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Acknowledgment & eligibility
These Terms are the agreement between you and Dolooma for use of the Service. You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement and accept these Terms and our Privacy Policy.
Your account
When you create an account you must provide accurate and complete information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us of any unauthorized use.
Acceptable use
You agree not to use the Service to post or transmit content that is:
- unlawful, or that promotes unlawful activity;
- defamatory, discriminatory or harmful to others;
- unsolicited or unauthorized promotion (spam);
- malware or anything designed to disrupt software or hardware;
- infringing on anyone’s intellectual property or other rights;
- impersonating any person or entity;
- a violation of the privacy of others; or
- false, inaccurate or misleading.
Intellectual property & feedback
The Service and its original content, features and functionality are and remain the exclusive property of Dolooma and its licensors. If you send us feedback or suggestions, you grant Dolooma the right to use them without restriction or obligation to you.
Third-party links
The Service may link to third-party websites or services that Dolooma does not control. We are not responsible for their content, policies or practices.
Subscriptions, billing & cancellation
- Plans and prices are as shown on our pricing page. Fees are in US dollars, charged in advance to the card on file, and do not include any applicable taxes.
- Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. We will give you at least 30 days’ notice before a price change takes effect.
- You can cancel at any time in the app. Cancellation takes effect at the end of the current paid period: you keep access until then and are not charged again.
- Fees are non-refundable, and we do not refund partial billing periods, except where the law requires it.
- An upgrade takes effect immediately, and the difference is charged for the rest of the current period. A downgrade takes effect at the start of the next period.
- If a payment fails, access is paused until it is paid. If it is still unpaid by the date we give you, the subscription ends.
- Enterprise plans are governed by the separate agreement signed with Dolooma.
Termination
We may suspend or terminate your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination your right to use the Service ceases.
Limitation of liability
To the maximum extent permitted by law, Dolooma’s total liability for any claim arising out of or relating to the Service is limited to the amount you actually paid for the Service, or USD $100 if you have not purchased anything. Dolooma is not liable for indirect, incidental, special or consequential damages.
"As is" and "as available" disclaimer
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Dolooma does not warrant that the Service will be uninterrupted, secure or error-free.
Governing law & disputes
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. You agree to first try to resolve any dispute informally by contacting us.
Changes to these Terms
We may revise these Terms from time to time. For material changes we will provide at least 30 days’ notice before they take effect. Continued use after changes take effect constitutes acceptance of the revised Terms.
